When it fits

  • The client pays a regular fee for updates, backups and a number of support hours.
  • Both sides want to agree in advance how fast requests are answered and what counts as extra work.

FAQ

Questions people ask

How is this different from the fixes after launch in the website design contract?

The website design contract can include fixes for a number of days after launch, or leave maintenance to a separate written agreement. This is that separate agreement: a regular fee, a set of services in each period, hours included, a first reply time and a term that renews or ends.

Does the first reply time promise that a problem is fixed in that time?

No. In this draft a first reply acknowledges the request and says what happens next. The draft also says the provider does not promise that the systems will be free of errors, attacks or interruptions.

What happens to hours that are not used?

You choose. Unused hours either expire at the end of the period or carry over to the next one. Work beyond the included hours is billed at the rate you type, or at a rate agreed in writing before the work starts, and only after the client approves it in writing.

Can the agreement renew by itself?

You choose. It can renew for a term of the same length unless one side gives notice before the end of the term, or it can end after the initial term unless both sides agree in writing to renew. The notice period is a number of days you set.

Is this legal advice?

No. Contracts.tools gives you an editable draft written in plain language and explains common clauses. It does not know your situation or the law where you live, and laws vary by country and state. Have the draft reviewed, ideally by a lawyer where you work, before anyone signs it.

Can I change the wording after downloading?

Yes. Download the Word file (.docx) and edit it in Word, LibreOffice or Google Docs. You can also copy the plain text. Change anything that does not fit your deal; the template is a starting point, not a fixed form.
